Commercial Listing Agreement
These submission terms supplement the Cividian Terms of Service and Privacy Policy. They describe the rights and responsibilities associated with brokerage applications, commercial property listings, property photographs, and inquiries.
1. Brokerage authority and professional identity
You must have authority to act for the brokerage organization you join or administer. Supply accurate professional names, brokerage details, license numbers, and license jurisdictions. Do not impersonate an owner, agent, or brokerage. Account email verification is distinct from professional license and brokerage-affiliation review.
2. Authority to advertise each property
Before submitting a property for publication, you confirm that you have current authority from the property owner or authorized brokerage to advertise that property through Cividian. You are responsible for restrictions in your listing agreement, brokerage policy, MLS rules, and applicable advertising laws. Provide evidence if the platform operator requests it. Withdraw the listing promptly if your authority ends.
3. Rights to photographs and submitted materials
You retain your rights in materials you supply. You confirm that you own them or have all permissions necessary for Cividian to host, store, resize, reproduce, and publicly display them as part of the listing and its Cividian property page or brochure. Representing a property does not automatically confer copyright in photographs, floor plans, or other materials. Do not upload materials copied from another listing platform unless you have permission for this use.
You grant Cividian a nonexclusive license to use submitted materials for these functions while the listing is published and to retain restricted copies as needed to operate the service, honor deletion requests, address disputes, and comply with legal obligations. Unpublishing removes the public property page and search presence. Copies already downloaded or cached by others may persist. These submission terms do not authorize syndication to third-party listing platforms or model training on your materials.
4. Listing accuracy and availability
Provide accurate asking prices, lease units and structures, property descriptions, sizes, availability, brokerage attribution, and required disclosures. Distinguish broker-supplied claims from independently verified facts. Zoning descriptions, utility capacity, surveys, plans, renderings, development potential, and financial projections must not imply approvals or guarantees that do not exist. Update, close, pause, or withdraw listings when circumstances change. A published listing expires after 90 days unless availability is reconfirmed.
5. Review, public display, and removal
Drafts and submissions are private to authorized brokerage members and the platform reviewer. Brokerage and agent review, property publication review, and platform launch approval are separate steps. Cividian may request corrections, decline a submission, suspend a brokerage or agent, or remove public visibility to investigate a complaint. A Cividian review badge does not guarantee the accuracy of a listing or certify the property, broker, or transaction.
6. Advertising and prohibited content
Observe applicable federal, state, and local advertising, consumer-protection, privacy, intellectual-property, and fair-housing requirements. Do not post discriminatory housing advertisements, misleading prices, false availability, unauthorized listings, private personal information, or malware. These requirements also apply to mixed-use property and land advertised for housing where the relevant housing laws apply. Automated text screening is a limited aid and does not replace professional review.
7. Inquiries and privacy
An inquiry shares the sender's name, verified account email, any optional phone number, and message with authorized editors and administrators of the listing brokerage. Use those details to respond to that inquiry and respect applicable consent and privacy requirements. An inquiry does not independently authorize bulk marketing, resale of contact details, or unrelated outreach. Listing page opens are aggregate activity counts and are not proof of unique buyers, demand, or conversion.
8. Data feeds, exports, and syndication
Direct uploads and CSV imports must contain inventory and materials you are authorized to provide. MLS, IDX, syndication, public-record, map, and other vendor data remain subject to their own agreements. An API or export capability does not expand those rights. Cividian does not obtain rights to Zillow, CoStar, or another provider's inventory through these submission terms.
9. Platform role and fees
This feature provides listing display, property research links, and inquiry tools. Submitting a listing does not engage Cividian to represent a party, negotiate a transaction, certify property feasibility, or hold transaction funds. Any brokerage, referral, transaction, advertising, or subscription services require separately defined terms and any applicable professional authorization. This partner feature does not collect transaction commissions.
10. Reports and copyright complaints
Use “Report listing” on a published property page to flag unauthorized, inaccurate, duplicate, discriminatory, or infringing material. Copyright complaints may also be sent through the copyright process in the Terms of Service or to contact@cividian.com. The platform operator must maintain the applicable copyright contact and operating process.
11. Account and brokerage closure
Brokerage records belong to the organization. A sole brokerage owner must transfer ownership before deleting an account when other members remain. Deleting a sole-member brokerage organization removes its listings, associated stored media, and inquiry records through the account-erasure workflow. Removing an individual agent's membership or approved profile ends public visibility for listings assigned to that agent. Shared brokerage records may remain with the organization, subject to the Privacy Policy and applicable obligations.
Prepared partner-beta terms. Production publication remains disabled until the platform owner has reviewed the operating entity, applicable brokerage and advertising requirements, and these terms with qualified counsel and approved activation.
